1. What VolaIndex is
VolaIndex (the “Service,” “we,” “us,” or “our”) is a commodity-pricing intelligence platform that aggregates public-source pricing data, news, and trade-flow signals, then publishes a weekly Monday brief and an interactive dashboard to invited subscribers (“you,” the “User”).
By accessing volaindex.com, signing into the app, or opening an email we've sent you, you agree to these Terms. If you don't agree, stop using the Service.
2. Not investment advice
Every piece of content VolaIndex publishes — the dashboard, the weekly brief, signal narratives, Vola chat responses, forecast bands, and the methodology pages — is commodity-pricing intelligence, not investment advice, securities research, trading recommendations, or fiduciary guidance.
We don't hold any of the licenses required to provide advisory services. Procurement, hedging, and sourcing decisions are yours alone. Data accuracy is not guaranteed, and historical signals do not predict future moves.
3. Eligibility and access
Access is granted on a case-by-case basis. You must be at least 18 years old, authorized to bind any organization you represent, and located in a jurisdiction where this Service is lawful. We may suspend or revoke access at any time, with or without cause.
Your login is for you only. Don't share credentials. Don't scrape, mirror, or republish the Service's outputs without our prior written consent.
4. Acceptable use
You agree not to:
- Use the Service to provide investment advice or trading signals to third parties without separate licensing.
- Resell, sublicense, or redistribute the weekly brief or dashboard content.
- Reverse-engineer, scrape, or systematically extract data from the Service.
- Use the Service to violate any law, regulation, or third-party right.
- Interfere with the Service's operation, attempt to gain unauthorized access, or transmit malicious code.
5. Source data and attribution
VolaIndex publishes derived analysis on top of public-source data from agencies including the U.S. Energy Information Administration, U.S. Census Bureau, U.S. Bureau of Labor Statistics (via FRED), USDA NASS, USDA AMS, SEC EDGAR, and commercial data partners. Every chart and brief section cites its source. Derived metrics (spreads, projections, estimates) are labeled as “VolaIndex analysis of [source] data” — they are not direct agency outputs.
No agency endorses or certifies the Service. References to public sources do not imply partnership.
6. Intellectual property + your data
The Service's code, design, methodology, brief layout, and synthesized analysis are owned by VolaIndex. Underlying public-source data belongs to its respective publishers and is used under their respective terms.
You retain ownership of anything you submit to the Service (supplier quotes, topic requests, Vola chat messages). By submitting it, you grant us a non-exclusive license to use it to operate, improve, and develop the Service for your own organization.
VolaIndex does not aggregate supplier-quote data across customer organizations.Your team's quotes are visible only to your org and are not pooled, anonymized, or otherwise combined with other customers' data to produce shared benchmarks, indices, or industry statistics. The pricing comparisons we surface put your team's own data next to public-market data we compute from public sources — never next to another customer's data, directly or derivatively.
7. Account changes and termination
You may stop using the Service at any time by signing out and not returning. We may suspend or terminate access if you breach these Terms, if continued access creates legal risk, or if we discontinue the Service. On termination, your right to access ends; data we've already published based on your submitted inputs may remain in our archives.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR SECURE.
Commodity markets move quickly and source data carries lag. Use VolaIndex content as one input among several in your procurement decisions, not as ground truth.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOLAINDEX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
10. Indemnification
You agree to indemnify and hold VolaIndex harmless from any third-party claim arising out of (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced through the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming. Both parties waive any objection to that venue.
